1. Introduction

1.1. These Terms and Conditions govern your use of EVE. By accessing EVE, you agree to be bound by:

• these Terms and Condition;
• Triple AI's Privacy Policy; and
• OpenAI Terms & Policies;

(collectively referred to as “Terms”), which may be updated from time to time.

1.2. For the purposes of these Terms, the following definitions apply:

• "You" or "Your" or "User" means the individual or entity accessing or using EVE.

• "Porsche" or "We" or "Us" or “Our” means Porsche Singapore Pte. Ltd., its affiliates, and all of its respective officers, employees, directors, agents, contractors, and assigns.
  

1.3. Please read these Terms carefully, as they form a legally binding agreement between you and Porsche. If you do not agree to these Terms, please do not use EVE.

2. Use of EVE

2.1. EVE is provided for your personal and non-commercial use only. It is designed to offer you information related to the Porsche brand as effectively as possible.

2.2. All responses, including advice, information, guidance, communication or content  generated or provided by EVE (collectively “Output”) are for informational purpose only. Any action taken based on EVE responses is at the your own risk.

3. Restrictions on Use

3.1. You shall not use EVE in the following manner, or for the following purposes:

• You may not use EVE for unlawful purposes or in any way that infringes on the rights of others;
• Create, upload, or share content that is offensive, illegal, or harmful;
• Attempt to or assist anyone to reverse engineer, decompile or discover the source code or underlying components of EVE, including our models, algorithms, or systems; or
• Use responses generated by EVE in any way other than for your own reference.  
  

4. Personal Data

4. 1. You should not provide any personal data to EVE. Any personal data you provide to EVE shall be deemed voluntary, at your own risk, and you agree to have provided your consent or has obtained from the respective data subject a valid consent, for the use and processing of your personal data.

4.2. You agree to defend, indemnify, and hold harmless Porsche, its officers, directors, employees, and agents, from and against any claims, actions, demands, liabilities, judgments, and settlements (including legal fees), resulting from or in connection with your provision of personal data to EVE.

5. Disclaimer

5.1. EVE is provided on an "as is" basis, without warranties of any kind (express, implied, statutory or otherwise). To the fullest extent permitted by law, Porsche and its affiliates, licensors and business partners disclaim all warranties, including but not limited to:

• Merchantability;
• Fitness for a particular purpose;
• Satisfactory quality;
• Non-infringement;
• Quiet enjoyment; and
• Any warranties arising out of the use of EVE.
  

5.2. We do not guarantee that EVE will be:

• Uninterrupted;
• Accurate;
• Error-free;
• Secure; or
• Free from content loss or alteration.
  

5.3. All Output generated by EVE shall in no way be construed as an offer, legally binding agreement, contracts, representations, warranties, or commitments of any kind on behalf of Porsche.

5.4. All Output generated by EVE does not reflect the official policy or position of Porsche.

5.5. Your interaction with EVE shall not alter any communication or contractual agrements of any business conducted with Porsche (including but not limited to the sale of vehicle), nor will it bind Porsche to any contractual obligations whether express or implied.

6. Limitation of Liability

6.1. To the fullest extent permitted by applicable law, Porsche shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from: (i) your access to or use of or inability to access or use EVE; (ii) any conduct or content of any third party on the services associated with EVE, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (iii) any Output obtained from EVE; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. User Idemnity

7.1. You agree to indemnify, defend, and hold harmless Porsche and its affiliates, and their respective officers, directors, employees, agents, licensors, and business partners from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from or in connection with your use of EVE.

8. Intellectual Property

8.1. All intellectual property rights in and to EVE, including but not limited to its Output, software, algorithms, text, images, user interface designs, and other content provided through EVE, are the exclusive property of Porsche and its licensors. This includes all copyrights, trademarks, patent rights, trade secrets, and other proprietary rights. No transfer or grant of rights is made or is to be implied by any provision of these terms or by the provision of services, and Porsche retains all rights not expressly granted under these terms.

9. Governing Law

9.1. These Terms shall be governed by and construed in accordance with the laws of Singapore.
